What Does It Mean That Roe v. Wade Was Overturned?

The Supreme Court decriminalized abortion in 1973 by ruling that the right to abortion was included in the “right to privacy and liberty” intent of the U.S. Constitution. The idea was that it was a woman’s right to privacy and personal liberty if she decided to terminate her pregnancy.

The current Supreme Court revisited this in June 2022, deliberating “whether the right to obtain an abortion is rooted in the Nation’s history” and determining that they were “reluctant” to recognize rights that are not mentioned in the Constitution.”

Because the right to elective abortion is no longer federally protected, each state must decide whether to protect or restrict abortion access.

What Are the Abortion Restrictions in New York?

Abortion was legalized in New York in 1970, three years before Roe v. Wade. Elective abortion is still legal in the state of New York up to the point of viability, or 24 weeks. 

If the woman’s life or health is endangered by the pregnancy, or if the fetus is not viable, abortion is available after 24 weeks.
